What’s in the Executive Order?
On March 25, 2025, President Trump signed an executive order seeking to create new requirements for federal elections. Among its key provisions, the order would:
Mandate proof of citizenship: Require the national mail voter registration form designed by the Election Assistance Commission to require applicants to provide documentary proof of citizenship as defined by a list of documents contained in the order: a U.S. passport or a REAL ID, military ID, or other state- or federal-issued ID that explicitly indicates the bearer is a U.S. citizen. This proposal is identical to one in the SAVE Act currently being considered in Congress.
Impose DOGE review of state voter registration databases: Require the Department of Homeland Security, in coordination with the DOGE Administrator, to review each state’s voter registration list to ensure consistency with federal requirements.
Involve federal law enforcement in elections: Direct the U.S. Attorney General to enter into agreements with state officials to investigate and prosecute suspected violations of state and federal election laws. States that fail to cooperate with the Attorney General would face withholding of federal grants and election-related funding.
Restrict mail ballot return deadline: Require all states to set a ballot receipt deadline of Election Day. States may not tabulate absentee or mail-in ballots received after Election Day for federal elections. States who fail to comply with this requirement face enforcement action by the Department of Justice and withholding of federal funds for election administration.
Talking Points on Executive Order From Voting Rights Lab
Our Constitution is clear: only Congress and the states may set the rules for our elections.
President Trump’s executive order is a direct attack on our Constitution and the checks and balances that have secured our elections for generations.
In America, voters pick their elected leaders, not the other way around. But in his new executive order, President Trump is attempting to seize power he does not have to try to change the rules for political gain.
Every state already has a strong set of checks and balances to ensure only eligible citizens vote.
If President Trump is successful in imposing these excessive, and likely unconstitutional, mandates on American citizens to register to vote – the impact would be astounding.
Less than half of American adults possess a valid passport, and millions lack access to a paper copy of their birth certificate. Few states issue REAL IDs that explicitly indicate the holder is a U.S. citizen.
Elected leaders at the state level run our elections and ensure that details like ballot return deadlines are fair for all voters across the board and implemented by bipartisan teams of officials.
The bottom line: This executive order attempts to wrap our state-run elections in massive federal government red tape, while handing Elon Musk the keys to sensitive state voter registration lists and systems.
We are confident this executive order will not stand up to scrutiny by the courts or by the American people.
Americans support rigorous checks and balances, they support the bipartisan teams of officials that faithfully carry out our elections, and they oppose efforts by politicians to meddle in these processes for their own perceived benefit.
I’m NOT confident that this won’t pass. Congress has basically the same plan under consideration in the House right now. (The SAVE act) Last summer it actually passed the House, but never made it to the Senate, so there is no reason to believe it won’t pass again.
I've been trying to learn more about just exactly an EO is and it's not a law, from what I understand and can't, in theory, be enforced. It does, I believe, give a green light to states that want to implement it. Even then, won't states have to change their voting laws through their state houses? It's more chaos, in any event.
